and Fines During the COVID-19 emergency - Delaware 

Good morning. I wanted to follow-up with our previous conversation regarding court collections.    

As we discussed last week, the courts have suspended the active collection of payment for assessments during the Judicial Emergency.  


Most of the policies have been in place since the beginning of the Emergency, and we most recently got agreement to put a halt to all tax intercepts on behalf of the courts.  

Since everything is in place now and the Administration has been notified, we have posted a public notice online.

Statement on Policies Regarding the Payment of Fees and Fines During the COVID-19 emergency 

Chief Justice Collins J. Seitz, Jr. declared a Judicial Emergency beginning on March 23, 2020. The Delaware Judiciary understands that this is a difficult time for Delaware families, and has made the following changes regarding the payment of assessments in light of the Judicial Emergency.
The Courts have suspended the active collection of payment for assessments, which includes the following changes for the length of the Judicial Emergency or until further notice, whichever date is later:
  • This includes all criminal, civil and traffic assessments. This moratorium does not apply to the collection and enforcement of child support.
  • Filing and Payment Centers located in the courthouses are closed to the public.
  • Capias returns for failure to pay are suspended throughout the Delaware Judiciary.
  • If you have an active capias for failure to pay issued prior to the emergency, please call the
    appropriate Court to determine if your capias may be cleared. (Contact phone numbers are
    listed below.)
  • Late notices and late fees for Voluntary Assessment Center obligations have been suspended.
  • All State Tax Refund and Lottery Winning Intercepts on behalf of the Delaware Courts will
    temporarily cease.

    The State of Delaware does not charge interest on criminal, civil, or traffic assessments.
