Boxwood News & Notes: Community Update

Good Afternoon Neighbors,

We are announcing a series of actions to address the concerns voiced at a Tuesday community meeting regarding ongoing demolition work at the former General Motors plant property on Boxwood Road. 

While regulatory bodies have found no violations regarding asbestos handling and removal at the property, and previous independent testing has revealed no related safety or health hazards at the site or the surrounding areas, we are taking the following steps to assure the community that the area is safe and all regulations are being adhered to.

Beginning this week, we will conduct daily tests on the fence line around the property to monitor air quality. In addition, we will hire an independent third-party environmental firm that will review work at the property to ensure all proper protocols are being followed.

The results of previous fence line testing at the property, conducted on April 6 and April 10, can be seen in the images attached.  

We will make the results of the new tests beginning this week available to the public as soon as they are completed.

County Executive to host community town halls this spring

New Castle, DE
 – New Castle County residents are invited to join County Executive Matt Meyer and county leaders for a series of Community Town Halls this spring, beginning on Thursday, April 18 in Odessa.  During each Town Hall, County Executive Meyer will summarize his proposed Fiscal Year 2020 Budget and engage with residents about the local services they receive. Each Community Town Hall will feature a brief informational presentation followed by a question and answer session.  These events follow the recent release of the County Executive’s proposed Fiscal Year 2020 budget thatbuilds on the historic success in public safety, improved public services, and government efficiency achieved in over the past two years.
“Please join us at Community Town Halls this spring as we share information about the many services provided by county government and engage in dialogue with residents about our work to save lives, protect the public health and drive our high quality of life,” County Executive Matt Meyer said.  “We welcome your questions and ideas.”

Update NCC UDC SECTION 40.31.230 Property line adjustments.






Hello Mr. Stirk,

I was asked to contact you regarding your inquiry about the property line adjustment process. Owners interested in this process should talk to an engineering firm about getting a new survey; the info required for the survey is below. The Department's application requirements are also below. 
 
Section 40.31.230 of the UDC (attached) describes the review process. There are three cases in which a property line adjustment shall not be processed by the Department: 
  • The subject parcels were created on an open space subdivision plan, planned unit development or alternative development option.
  • The adjustment would result in the transfer of a dwelling from one parcel to the other.
  • Buildings, structures or uses on either of the subject parcels do not conform with this Chapter and do not have confirmed nonconforming status under Article 8.
  •  
Per this same section, once a property line adjustment survey has been approved by the Department, the applicant shall have one year to revise and record the new deeds.



Property line adjustment survey requirements (from Appendix 1.3.N of Chapter 40 of the New Castle County Code:):
  • The property line adjustment survey must be drawn to scale. 
  • The property line adjustment survey must include:
    • Tax parcel numbers for all subject properties. 
    • Lot lines described with bearings and distances in accordance with professional Delaware State surveying standards.
    • Identification, location, and distance of all improvements (stick-built or manufactured structures, pole-buildings, or any other structures) from property lines after adjustment.
    • Delineation of all protected resources established by Article 10. 
    • Dimensions and size (square feet or acres) of all proposed tracts prior to and after the proposed property line adjustment.
    • Legend. 
    • All abutting streets (noting whether public or private), including name. 
    • All existing easements, including widths and types, specifically noting the use, whom they serve and deed recording information.
    • Location of any wells or septic systems.
  • The survey shall be signed, sealed and dated by a Delaware P.E./P.L.S
The following materials are needed for a complete application submission:
  • A completed SLD-1 form available on our website
  • $500 fee 
  • One (1) copy of any deed restrictions to which New Castle County is a party 
  • Provide verification from the County Department of Finance proving that county taxes, school taxes and sewer service fees on subject properties have been paid or are not delinquent
  • 3 printed copies of a property line adjustment survey. 
  • A CD, e-mailed or Drop Box digital copy of survey

Sorry for the delay, we were waiting on a couple of coordinated efforts.  In response to the Marbrook School area requests:
·         Turn restrictions at Centerville Rd, Rhode Island Ave, and Marbrook Elementary Entrance – DelDOT Traffic will observe and count traffic during the school start/ending time periods, and evaluate if modified restrictions may be helpful at this intersection

·         Removal of the bushes – DelDOT Traffic has requested for North District Maintenance to investigate

·         Extending the parking restrictions in front of the school – DelDOT Traffic will investigate existing signage and evaluate the extended restriction

As part of a separate effort, Marbrook Elementary School was recently evaluated as part of a school zone compliance review to update the signage and striping relating to the school zone and potential student crossings.  The recommendations were finished last Fall, and we will confirm that these improvements have been implemented correctly.
